When A Life Is Lost On The Job

When a death occurs in the workplace, employers often refer grieving family members to the workers' compensation system. Unfortunately, workers' compensation benefits are limited and may not go far in solving financial issues caused by the death. You may have other options.

Since 1993, the Law Offices of James L. O'Rourke has advised families who lost loved ones in accidents. Our lawyers will take the time to evaluate your case and explain your options at no cost. With offices in Stratford, Shelton , we represent families throughout the Greater Bridgeport area.

Even if you have been told that you cannot sue your employer for your loved one's death, contact our attorneys for a free second opinion.

Can I Sue My Family Member's Employer?

While employers are generally protected from wrongful death lawsuits in the case of fatal workplace accidents, there are exceptions. Here are some cases when you may have the right to sue:

  • Accidents caused by deliberate intent of your family member's employer. For example, if the employer knew of an unsafe condition in the workplace and took no steps to correct it, you may have a right to sue the employer.
  • Accidents caused by third parties. If the accident was caused by someone who does not work for your family member's employer, you can sue him or her. An example of a third party is another driver in a car accident.
  • Accidents caused by dangerous equipment. If your loved one was killed in an accident involving a dangerous machine or hazardous chemical, the manufacturer may be liable.

We handle all fatal accident cases on a contingency fee basis, so we only charge a fee if we are successful in recovering compensation for you.
